Municipal ordinances are evolving — and in some cities, they are placing new and significant legal responsibilities on real estate professionals.


This Broker Advocacy Briefing will focus on the growing use of “Local Agent in Charge” ordinances, including requirements being implemented in municipalities throughout the Cleveland area. These ordinances often require a licensed real estate professional authorized by a property owner to be designated as the “Local Agent in Charge” for rental or vacant properties — in some cases assigning legal responsibility and liability to that individual and potentially to the brokerage for code violations.


During this briefing, brokers will gain a clear understanding of:

  • What “Local Agent in Charge” ordinances require
  • The potential legal and liability implications for brokers and brokerages
  • E&O insurance considerations and exposure risks
  • How these ordinances may impact brokerage operations and policy
  • The advocacy efforts underway to protect brokers and ensure agents serve as a conduit of information rather than assume unintended legal liability


Attorney Dean DePiero will provide legal insight and guidance regarding risk management and insurance considerations. Jamie McMillen, ACAR’s Vice President of Advocacy will provide an overview of the advocacy work being done by ACAR and insight into other Ordinances that have become a risk for real estate brokers and agents.


This session is designed specifically for Brokers, Managing Brokers, and brokerage leadership who need to understand their exposure and make informed decisions for their firms.
